All cell/smart phone are hackable and trackable in a variety of ways. A device that is powered is controlled by its software, not you. One piece of malware is all it takes to make it go rogue on you.
The best malware takes an expert to find and is beyond the capabilities of almost anyone else to detect. They don't call them spooks for nothing...

If you make the sorry ass mistake of inadvertently wandering into an active operation* and attract their attentions you will come under their scrutiny. The FBI and the DEA, who are big users of this technology has the authority to enforce federal, state and local laws.
*Meth labs, gangbangers/terrorist AO, etc.

intercepted real time and recorded. The capability to download trojans and Spyware directly onto devices without the user's knowledge also exist. Automatic updates including security certificate permission should always be disable on the device although even this may not be enough to stop an advanced cyber attack. Complete powered down is the only full proof method to avoid being compromised.
