Back in May, I created a facebook page as a fan page for the Dropkick Murphys. Back then, anyone was allowed to create a page in hommage to a musician, band, actor, etc.
Anyways, from May until now, my fan page has gained over 12,000 people! I update it with tour dates, etc., and I have even mentioned many times that I was not affiliated with the band, and that the page was merely a fan site.
Anyways, yesterday I received a message from the Dropkick Murphys manager, harassing me about how I created a page that I wasn't supposed to and that if I don't remove myself from the admin list, I will have problems to deal with! The way the messages are written are in a very unprofessional manner, especially for someone who is supposed to be the band's manager! I've received a least 3 messages from her since yesterday and I'm getting really pissed off because I created this fan page over 4 months ago, I put time and effort into it, promoted it, and now have over 12,000 fans joined. What am I supposed to do? I thought about sending an email to the band to complain, but it says on their site that the manager reads the emails and forwards them to the band if the band has time.

Never under estimate the douchebaggery that spawns from music industry "workers".

I was just on a music forum where someone pointed out that such-and-such band's new album has leaked months before release date.

Everyone was like "woooooo".

I went on Google, found the leak, downloaded it - less than 5 minutes of wait time.

Then I posted the link.

They lady from the label freaked. How dare I post the link to the leak that the fine, innocent previous poster mentioned.

She got all pissed and said she was quitting the forum because my posting the link could put her job in jeopardy with her bosses.

Jesus fcuk!

That's messed up. Especially if you like the band and it's in homage of them.

Just make sure you don't host any copyrighted music, video, or pictures. Also if the site blatantly states it's a fans site you should be all good.

Did they send a nastygram or a DMCA letter?

Is sounds like they're trying to bully for no good reason. Anyway to get a hold of one of the band members directly and inform them of this?

I just think it's funny that the band hasn't yet made a facebook page, and now all of a sudden, after they realize I put time and effort into getting 12,000 people to join the page I created, they want to come and take it away from me.

My guess is that it sounds like you're getting a good amount of traffic on your site and they feel like you're "stealing" visitors to the real DKM site.


I would say Eff them until they try legal threats. If they do, do your homework before responding, because you know it's going to be a BS threat as long as you have all your bases covered.

Any way to contact a band member via their myspace or something?

If you know a band members name, the county/state where they live (they must own property) and PM it over to me I can look up their address for you and PM it over. You could actually write the band a nice letter about their manager.

When you create a facebook page, you are automatically the Administrator... so where it says Admin on the facebook page I created, it says my name and now it says the supposed Manager's name (Dianne Meyer)...

I don't host copyrighted music or photos. The videos and photos on my page are posted solely by fans!
She sent me a nastygram!
And no, there is no way to contact the band because every contact point Ive tried, just gets back to the Manager!

Funny though, in the page I made, I posted the band's website URL and info so that people can go to the actual site to see more stuff. I'm not stealing fans, I'm promoting a band I love!

It sucks a bit, but the fact is, you are using their name to get eyeballs, which can be used easily on Facebook, to make money, in which case you are using the bands name image and reputation to make money. In addition, you could, at any time, decide to say that the band supports raping children, or voting for McCain, or something equally disturbing.

That is their point of view. You could fuck up the bands reputation and business. The potential harm that you could cause them is large. The potential harm to you for them getting control of the page is minimal, at least as far as nothing that is yours will be taken away from you.

Also, if they do nothing to stop you from using the name, then they are in effect giving up the copyright to the band's name, since they have to defend it in order to claim that it is theirs to use.

Good points MM. Though I would be curious to see what happens if you publish the correspondence from the manager to right in the open on the site. Haha.

I gave vicex a band members address via PM, so hopefully a nice letter to him will let him see what a douche his manager is.

Of course someone will be pissed that you posted a link to the band's album. If she was responsible for the leak and was making it available to some people privately, then she will get fired and sued for possibly millions of dollars if it gets out of hand. She was stupid for allowing it to happen, but how do you not understand that she would be upset that you may have just helped to end her career and reputation?


I'm probably reading the specifics wrong, but either way, of course someone will be mad that anyone is posting links to the album.

Like I said, you are getting eyeballs. Eyeballs are money, or at least potential money. You could use the page to promote other things and get traffic/customers. whatever.

"could" is the magical word. Your not doing anything wrong as your not making any money off of the band. By posting references and links to what your referring to or where the main source of information comes from also is basically stating that the information is not yours and you did not create it.

I wouldn't really give it a second though till a Lawyer got involved. Even then as long as your not using copyrighted material for profit they really can't do anything.

Um ... how do you know that she is absolutely, positively 100% the band's REAL manager?

Let's see ...
1. We've got one video (probably copywritten/used without permission)
2. An album with quite a few probably copywritten and professional photos
3. The most recent post about "tour dates" is a copy+paste job from the band's real website, yet:
----You don't cite your source (definitely plagiarism)
----You leave it looking as if they'd posted it (potential identity impersonation)
4. The biography section is a copy+paste job from the website
----Again, source not cited
----Again, it appears as if the Dropkick Murphys have posted this, themselves
5. The main picture is not cited, though it is clearly professional
6. I'm sure there's some copywritten rules that go along with that huge Discography section you've got going on
7. I found NOWHERE on that entire thing where you claim that it is a fan page ONLY and that you're NOT the Dropkick Murphys. As a matter of fact, "DKM" and "The Dropkick Murphys" is posted as the signature on almost all of the plagiarized posts, implying that YOU are the Dropkick Murphys.


I wrote that first line, "How can you be sure she's the manager?" before I went to the page. After I went to the page ...

I'm sure she's probably the real manager. And you're committing identity impersonation, plagiarism, copyright infringement, and probably numerous other illegal acts.
Frankly, I think this is the calm before the you-getting-sued storm, and you'd better get rid of that copywritten/plagiarized material REAL QUICK, and post EVERYWHERE on that page that YOU ARE JUST A FAN, THIS PAGE IS NOT AFFILIATED WITH THE DKM AT ALL!

However, if that isn't your page ... Then you aren't being forthcoming with how many members you ACTUALLY have. This is the only DKM page on facebook that I found to have 12k+ members.

1.) Originally in the photos section, there were over 160 photos all taken by FANS and added by FANS. NOW, there is only one section called "Band photos" and these were uploaded by the manager and she erased all of the photos the FANS took/uploaded!
2.) The main picture was ADDED BY THE SUPPOSED MANAGER 2 DAYS AGO. Previous to her coming aboard and taking over the page, I had a band picture I took from a show as the main picture.
3.) The discography related things (cd cover pictures, song list, etc.) was also recently added by the "supposed" manager.
4.) There used to be 3 VIDEOS that were added by FANS. NOW there is one video, and it was added by the manager! I allowed the option of fans adding pictures, video clips, etc., if they wanted to!

And as for me posting somwhere on the page that I am not the band, well, if you haven't clearly read my original post, the supposed manager completed a major overhaul in the last two days of the page I created! That's why there are new 2008-2009 tour dates, some topics on the message board have been deleted, and yes, I did post a whole thread about how the page was a FAN PAGE and I was NOT affiliated with the band, but since taking over the page, the bitch erased everything I had posted on there! If you would have checked the page maybe, I don't know, 4 days ago, you would have seen that I wasn't impersonating the band whatsoever!

So since you don't know the whole story/history/previous posted information on the page, don't fucking tell me off! You have no right pointing any fingers if you have no fucking clue about what actually happened. Do you always stick your nose into everything and think that you are right about every goddamn thing?
