Security Gaurds are citizens who are hired by companies to watch their property or investments.



Depending on the country and state/province, these guards may or may not have power over you. Generally, if you are on their property, they have the right to question you, but not the right to touch you, search you, etc. Also, you do not have to show them your identification, nor do you have to allow yourself to be searched.

In Ontario, all security guards must turn in their license for inspection by anyone who asks while on duty, or they personally face a $5000 fine and their company faces a $25,000 fine (minimum).

Often called "rent-a-cops", these guards often try to use intimidation and misdirection to make themselves sound more powerful than they are. They will often lie about their rights. Do not listen to what they say.

Inhouse security, such as what they have at the Skydome or the Eaton Centre, do NOT need a Guard license, so they don't have to show you one. But, generally speaking, any guard in a Security Company uniform (Intelligarde, Intercon, Group 4, etc...) is bound by these rules.


In many states, such as Florida, it is entirely legal for an ordinary citizen to detain a criminal to facilitate an arrest by law enforcement. This includes security officers, who can legally detain you for trespassing on private property. The officer is then required to immediately notify law enforcement.

While detention is very similar to arrest, the power to arrest is statutorily reserved to law enforcement officers, and particularly to the several sheriffs and those whom a sheriff chooses to assist him. Security officers play a vital role in the protection of public and private property by lending assistance in the detention process, that process that precedes the actual arrest by law enforcement. As Justice Kogan put it, in a 1991 Florida Supreme Court case, ". . .they serve as a stopgap. . . until law enforcement officers arrive." Law enforcement often cannot be effective without such assistance.

Citizen's arrest is not expressly granted anywhere in the Florida Statutes but is a creation of the common law in Florida. It is a legal concept that allows a private citizen (security officers included) to arrest another when a felony is committed in the citizen's presence.
