| | | Sewer explorers charged with mischief
Two men who claim they have been exploring and photographing Toronto's network of sewers for six years appear to have explored one too many Sunday night and are facing charges of mischief as a result. So and So, geared up with head lamps and hip waders, entered the sewer system near Ossington Avenue and Dundas Street West, police said. A passerby spotted them climbing into the sewer and called police, who showed up with four fire trucks and a hazardous materials team. Four hours later, So and So were found, arrested and charged. Toronto police Det. Dan Hoffmeyer said storm sewers can be dangerous. "Down there, there's poisonous gasses," he said. "Hazmat crews here go down with breathing apparatus, or they just [send] down [a] video camera — they don't go down personally. "There's [also] a chance of the tunnel filling up in a matter of minutes and people drowning. If there was a storm somewhere, they'd fill up in a matter of seconds." According to a website run by So and So, they've been exploring and photographing the underbelly of Toronto for six years and recording the finds on the site. There's no word yet on what Sunday night's search and arrest cost the city. When asked about the legality of entering the sewer system, Hoffmeyer said: "I guess without permission [of the city], yes, it's illegal." Whether all of the men's previous forays into Toronto's underground were without permission, he said he had no way to know.
EDIT: Removed names. The reason I didn't initially is because they are already available quite publically. But fine, I will do it anyway... [last edit 4/5/2010 8:25 PM by Rust - edited 2 times]

| | | I'm not from Toronto (yet...) but I know Dundas is one f.ing busy street. Maybe it was the only entrance into this network, but I doubt it. Besides, isn't popping a cover in plain sight a bit suspicious on its own?? At a very minimum, pop the manhole going outbound, not inbound, so they don't have to call in SAR and hazmat!

| | | Depends on the time. Dundas and Ossington can actually be very quiet later at night. Hope things work out for the two of them.

FYI, the story mentioned the manhole is near Dundas. It's in a quiet little park on a quiet side street a few blocks from Dundas and Ossington. It's also (as far as I can remember) the only manhole into that section of that system that's not actually in a road. I suspect the people in question probably don't need advice from you on how to drain, but if you want to offer it anyway, that's your call.

In Canada, it is the most serious charge there is. "Tomfoolery" is the next lowest.

I stand corrected. The original post said the manhole was on Dundas near Ossington; the actual article and current edited post have the correct location, which no longer seems like such a dubious place to enter a drain. Also, so much for my thought that no one could get caught in drains. Now it's my turn...a year and a quarter exploring the way I do, and not arrested once, is starting to be more luck than anything.

| | | Mischief is a criminal offense, not a statutory one, and will therefore result in a criminal record upon conviction. That being said, I highly doubt our friends from the vanishing point will have to worry - it's unlikely the charge will stick. A good lawyer will get the Crown to negotiate something else.

Nope. What else would they charge them with? Trespassing is too lenient in respect to the unnecessary response by TFS. Not to mention a criminal trespass charge wouldn't likely stick since there were no notices posted, nor any criminal intent. Mischief is a "catch-all" charge that Police use all the time. It's about as low on the totem pole of criminal charges as you can get. [last edit 4/5/2010 10:27 PM by el nerdo - edited 1 times]

Perhaps I'm just so used to the usual "It's dangerous in there, don't try it again, here's your ticket" that all this fuss seems unnecessary.

And that would have probably been the case if the city didn't send 4 fire trucks, dozens of firefighters and the press didn't show up. The charge was levied due to the exposure; that's it.

You can pay the fine ONLINE? wat?! Also its interesting to note that this wasn't cross plastered with full names as its been done before. Maybe discretion is catching on here...

The difference between posting it in full on UER and it being google-able is, to me, a matter of respect (and having a slight amount of patience to find out). Good luck to those involved, and too bad the CYA cops had to bring in the full terror squad on this one.
